I took these photos- lipizzaner stallions performance- can i send them to get in a magazine?
I went to this Lipizanner stallion performance and took lots of photos. I got a ton of really good ones, that look professional. I just want to make sure but I am writing an article for a magazine about the Lipizanner stallion and I was wondering if I could use those photos I took in with my article. They did let us take photos, it shouldnt be a problem for ME to use them how I want, since i took them. RIght???
You absolutely, positively MUST have a Property Release from the owners of the horses. I honestly doubt you’ll get one since the name “Lipizzaner Stallions” and the performance is protected under copyright and trademark law. If you were using the pictures in a newspaper there wouldn’t be a problem.
Its really no different than you owning a really unique tree and me standing in the street and photographing it to use in a calendar. If you see YOUR tree in MY calendar you’ll probably want a piece of the action and have your attorney inform me of your desires.
